Indicators of Insolvency and Director Duties


This webinar provides attendees with an overview of the key insolvency indicators and director’s duties at common law and under the Corporations Act 2001 (Cth) with a particular focus on the insolvency provisions.

This presentation will provide attendees with an overview of their statutory duties as directors and what they need to be aware of while discharging their duties to the company.

Andrew will provide insights and some common examples, referencing case law, that cover the following:

  • The indicators of insolvency
  • What are a directors' duties?
  • What constitutes a breach of those duties?
  • What defenses may be available to directors
  • What a director's potential personal exposure may be?

He will include some simple analysis tools that advisors can apply to their client's circumstances that may assist them in determining the compliance with their directors’ duties.

Presenter Bio:
Andrew Blundell is a registered liquidator and is a Partner in the Sydney office of Worrells Solvency & Forensic Accountants. In addition to 13 years’ experience in Insolvency and Corporate Advisory, Andrew spent 5 years in the United States in both management and public practice accounting roles. He holds a Bachelor’s degree in Accounting and Marketing from the University of Western Sydney, a Diploma in Advanced Insolvency Law from the University of Southern Queensland, has completed the CPA Australia Program and is a full member of the Australian Restructuring, Insolvency and Turnaround Association (ARITA), Institute of Professional Accountants and of CPA Australia.
