Legal Professional Privilege – Recent Developments and Practical Implications for Making Claims

Overview

How claims for the LPP will be managed by the ATO in practice.

Understanding the scope of legal professional privilege is an important element of managing any review or audit by the ATO or responding to a request by the ATO for information.

In recent years, reckless claims of privilege have been a key focus of the ATO and a number of recent cases have highlighted its willingness to dispute claims which it considers are excessive or unfounded.

The ATO has also released a finalised protocol on how taxpayers should make privilege claims.

In this session, we will:

•    summarise the current scope of legal professional privilege,

•    explore the practical implications of recent case law on privilege,

•    identify what the ATO’s new protocols mean for taxpayers making privilege claims and

•    outline the key considerations in developing an internal tax governance framework that ensures privilege can be appropriately claimed in the event of an audit or review or request for information

Learning Outcomes:

Attendees will gain an understanding of the scope of legal professional privilege and the practical implications of recent developments in the law

Suited to:
